Terms of Service

1. The agreement

These terms are an agreement between you and [TODO: legal entity name], registered at [TODO: registered address] (“FocusTribe”, “we”, “us”). They govern your use of the FocusTribe website and application at focustribe.in. By signing in or otherwise using the service you accept them. If you do not accept them, do not use the service.

Our Privacy Policy, Cookie Policy, and Refund Policy form part of this agreement.

2. Eligibility

You must be at least 16 years old to use FocusTribe, or at least 13 where local law permits and a parent or guardian consents on your behalf. You must have the legal capacity to enter into this agreement. If you are using FocusTribe on behalf of an organisation, you confirm you have authority to bind that organisation to these terms.

3. Your account and Google sign-in

FocusTribe accounts are created through Google sign-in only. There is no email-and-password option, so we never hold a password for you and you cannot reset one with us. Access to FocusTribe therefore depends on your continued access to your Google Account, and your use of that account is governed by your agreement with Google, not by us.

You are responsible for keeping your Google Account secure and for everything that happens under your FocusTribe account. Tell us at kalpesh@buildifyapp.in if you believe your account has been accessed without your permission.

A FocusTribe workspace holds a maximum of two members. Anyone holding a workspace invite link or code can join a workspace that has fewer than two members, so share invite links only with the person you intend to work alongside. Both members of a workspace can see and edit the tasks in that workspace.

4. Acceptable use

You agree not to:

• use FocusTribe for anything unlawful, or to store or transmit unlawful content;
• harass, abuse, threaten, or impersonate anyone, including the other member of your workspace;
• upload or enter content you have no right to share, including someone else’s confidential or personal information;
• attempt to access accounts, workspaces, or data that are not yours, or to circumvent the security rules that protect them;
• probe, scan, overload, or otherwise interfere with the service or its infrastructure, or attempt to bypass any rate limit or usage restriction;
• scrape, crawl, or bulk-extract data from the service by automated means without our written permission;
• reverse engineer, decompile, or attempt to derive the source of any part of the service except to the extent applicable law says you may;
• resell, sublicense, or commercially exploit the service without our written permission.

5. Your content stays yours

You own your content. The tasks you write, the notes attached to them, your daily reflections, and everything else you enter into FocusTribe remain yours. We claim no ownership of any of it.

To operate the service we need a narrow, purely functional licence from you: a worldwide, non-exclusive, royalty-free licence to host, store, back up, transmit, and display your content, solely so that we can provide FocusTribe to you and to the other member of your workspace where the product is designed to show it. That licence exists only for the purpose of running the service and ends when the content is deleted, except for any residual copies held in routine backups until those expire. We do not use your content to advertise to you, we do not sell it, and we do not use it to train machine learning models.

You are responsible for your content, including for having the right to store it and for its accuracy and legality.

6. The service is provided “as is”

FocusTribe is free to use and is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent the law allows.

We do not promise any particular level of uptime, and we make no service level commitment. The service depends on third-party infrastructure — Google Firebase for authentication and data storage, and Vercel for hosting — and outages, maintenance, or changes at those providers can interrupt it. Features may change, be added, or be removed at any time.

FocusTribe is a productivity tool, not a medical, psychological, or professional advisory service. The reflections, analytics, and statistics it shows you are descriptions of what you entered, not advice. In particular, the focus-minute figures shown in analytics are derived from the durations you planned for your tasks; they are not an independent measurement of time you actually spent working.

Keep your own copies of anything important. We do not guarantee that your data will never be lost, and we strongly recommend you do not rely on FocusTribe as the only record of anything you cannot afford to lose.

7. Suspension and termination

You may stop using FocusTribe at any time. The person who created a workspace can delete that workspace from inside the app, which removes the workspace record.

Account deletion is not yet self-serve. There is no “delete my account” button in the product today. Until we ship one, email kalpesh@buildifyapp.in from the address on your account and we will delete your account record and the workspace data associated with it.

We may suspend or terminate your access if you breach these terms, if your use puts the service or other users at risk, or if we are required to by law. Where it is reasonable and lawful to do so, we will tell you why and give you a chance to put things right first. We may also discontinue the service as a whole; if we do, we will give reasonable advance notice by email or in the app so you can export or copy your data.

8. What happens to your data

If you delete a workspace, the workspace record is removed and the content in it stops being available to either member. If you ask us to delete your account, we delete your account record and the associated workspace data, and we aim to complete the request within 30 days. Residual copies may persist in routine backups until those backups expire, and we may retain the minimum data we are legally required to keep.

Deletion is permanent and we cannot restore deleted content. Full detail on retention is in the Privacy Policy.

9. Limitation of liability

To the fullest extent permitted by law, FocusTribe and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages, nor for any loss of profits, revenue, goodwill, data, or business opportunity, arising out of or connected with your use of or inability to use the service, even if we have been advised of the possibility of such damage.

To the fullest extent permitted by law, our total aggregate liability to you for all claims relating to the service is limited to the greater of the amount you paid us for the service in the twelve months before the claim arose — which, while FocusTribe is free, is zero — or [TODO: liability cap amount].

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. If you are a consumer, you keep all the statutory rights your local law gives you, and nothing here overrides them.

10. Indemnity

You agree to indemnify and hold harmless FocusTribe and its operators from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your content, your use of the service, or your breach of these terms. This does not apply to the extent the claim arises from our own breach or negligence.

11. Changes to these terms

We may update these terms as the product changes or as the law requires. The “last updated” date at the top always reflects the current version. For material changes we will give reasonable notice by email or in the app before they take effect. Continuing to use FocusTribe after a change takes effect means you accept the updated terms; if you do not accept them, stop using the service and ask us to delete your account.

12. Governing law and disputes

These terms are governed by the laws of [TODO: governing law jurisdiction], without regard to its conflict of law rules, and the courts of [TODO: courts / venue for disputes] have exclusive jurisdiction over any dispute arising from them. If you are a consumer resident in the European Economic Area or the United Kingdom, this does not deprive you of the protection of the mandatory consumer law of the country where you live, or of your right to bring proceedings there.

13. General

If any provision of these terms is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign this agreement without our consent; we may assign it as part of a merger, acquisition, or sale of assets, on notice to you. These terms, together with the policies linked in section 1, are the entire agreement between you and us about the service.
